<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals and <br />Geology. Henry Austin of OSM concurrently conducted an oversight inspection focusing on off-site <br />impacts of a site in temporary cessation. The operator was represented by Jay James of Montgomery <br />Watson (the operator's local agent), and Mike Altavilla and Brian Dunfee of Peabody Group. <br />The weather was hot and the ground was dry. Vegetation was turning brown. Significant rain had not <br />fallent for more than a week. Work men were on-site as the load-out is reactivating for use as a <br />coal transfer point. Although it returned to active status 6/27/00. coal loading is not expected <br />for some time yet because a radial stacker and related equipment will be constructed. These new <br />facilities have been proposed in Technical Revision TR-5 which CDMG is reviewing. <br />SIGNS AND MARKERS <br />Mine entrance signs and permit boundary markers were properly displayed. A stream buffer sign near <br />the rail loop pond was re-installed during the inspection. <br />ROADS <br />The Tie-across Haul Road is in good shape. The access road ~n the office area and Haul Roads 1 and <br />2 are in good condition. <br />HYDROLOGIC BALANCE <br />Ditches - The westernmost 20 feet of Duch 9 needs a small amounnt of reshaping where it bladed <br />recently, although it is capable of functioning. <br />Sediment Control Ponds -The water level in the truck loop pond (Pond 1) was approximately two feet <br />below the top of the drop inlet. A small puddle of water was ~n the rail loop pond. Both ponds' <br />inslopes, outslopes, and embankments appear stable, and were not Bullied. Sediment markers were in <br />place. <br />SUPPORT FACILITIES <br />The operator's representatives explained additions and modifications to the facilities area that are <br />proposed in TR-5 (in review). No new ground will be disturbed. <br />REVEGETATION <br />Canada thistle are locally abundant at the Loadout and need to be controlled. The operator's <br />representative said a weed control program will be started. <br />SAES <br />The office/parking lot/leach field SAE is in good shape. The substation SAE needs vegetation <br />growing. Past seeding efforts have been unsuccessful. <br />Page 3 <br />
