~` <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion o} observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. Bill Bear represented the operator. <br />Hydroloev <br />The water level in pond B was just above the primazy dischazge pipe inlet. The gate valve was <br />closed so there was no discharge. The water was from a recent wash down of the entrance road <br />and coal loading area. The water in Pond B was blackish in color. <br />The pond B embankment appeazed to be geo-technically stable. The embankment was seeded in <br />late spring but not much vegetation has come up yet. <br />The silt fence down gradient of the pond was functional. The pond spillways were intact. The <br />Old Highway 133 road culvert leading to the west end of Pond B was clear. The riprap was in <br />place leading from the culvert to Pond B. The road culvert, drop structure and ditch leading to <br />the east end of Pond B were functional. <br />Facilities <br />The operator has set up a demonstration processing plant on the south side of the coal stockpile. <br />The plant will use air rather than water to process the gob pile material. <br />There were no problems with fugitive dust at the mine site. <br />Roads <br />The paved main haul road was in excellent condition. <br />c:\ms97\bowie IGnsp0801 <br />
