Enforcement <br />action Forthcoming. <br />OBSERVATIONS OF Il`1PORTANCE: <br />1) Two separate operations are included on one permit. Operator must cross Yampa P.iver <br />during laa water to reach Southern Pit. <br />2) Operator has mined predaninantly from River to date. <br />3) Several portions of the River bank have been rip-rapped with broken concrete fop erosion <br />control, without an Army Corps of Engineers ~k404 Permit. <br />4) No annual reports/notice of intent to continue are on file. <br />5) Cotton<aood and riparian vegetation will be affected by future mining. <br />6) Beaver activity has been severe and has resulted in the loss of matzse cottonwood @ 12" dbh <br />and greater. <br />7) Operation has been in existence prior to 1973 with 9.9 acres of prior disturbance. <br />8) Operator plans to affect previously tmdisttsbed gramd, thereby expanding the operation <br />north of the Yampa beyond the 9.9 acres permitted for both operations. <br />9) Topsoil disposition is unclear. <br />RECQ"MEI~IDATIONS: <br />1) Sutmit an annual report/notice of intent to continue. Include a map with a scale showing <br />the permit area to a scale of approximately 1" = 200' and showing all significant features <br />of land (for example: extent or reach of rip rap on banks, plant area, ponds, cottonwood <br />tree locations, access roads, buildings, topsoil and deposit stockpile areas, etc.). <br />2) Contact U.S. Army Corps of Engineers to see if rip rap requires a 704 permit. <br />3) Make northern and southern permit areas two distinct permits. <br />4) If disturbance on northern pit is to be expanded or is presently different than that <br />described in permit, amend this permit area to reflect the proposed changes.
