(Page 2) <br />MINE ID # OR PROSPECTING ID # : ~~-~ ooo-nn~ <br />INSPECTION DATE: ~-2cL-n.~ INSPECTOR'S INITIALS: ~_ <br />OBSERVATIONS <br />The Division conducted pre-operational inspection of the site on 1-24-03. The site is a 112 sand and gravel <br />operation. The operator submitted an amendment to expand the affected acreage by 35 acres. The 35 acres <br />were included in the permit area when the permit was approved in 1999. Operator felt the need to not affect it <br />until the wetlands issue was resolved. Due to the flooding that took place in the area, in 1998, the parcel was <br />covered with water, and the operator felt it was a good idea to not mine it until the Army Corps resolved the <br />issue. Since that time, the Army Corps had visited the site and according to the operator concluded that there <br />were no jurisdictional wet lands in the area. Even though the operator chose to submit an Amendment, the area <br />to be added (35 acres) could have been included to the permit affected acreage, through a Technical Revision <br />process. Post mining land use is the same as was approved in the original application, which is an unlined <br />pond. Present during the inspection was Mr. Ed kite, the operator's representative: The entire 35 acres fo be <br />affected was driven and inspected. There was no standing water or what appeared to be wetlands vegetation <br />noted. However, the entire 35 acres were infested with what appeared to be Musk Thistle. Permit Amendment <br />application sign was properly posted. There were no man made structures other than a fence owned by the <br />operator along the west side that was noted.
