III. COMMENTS -COMPLIANCE <br />Below are comments on the ~nspechon The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mmrng. and Safety (Division). This former mountaintop removal operation is in <br />the final stages of completing reclamation. The site has achieved a Phase I bond release for <br />most areas. Ground conditions on this day were dry and the weather was cool and breezy. <br />Fish and Wildlife <br />Four mule deer were grazing on the upper portion of Fill 8. <br />Revegetation <br />Grasses and (orbs are coming on rapidly on south and west-facing slopes that are in at least <br />the second year following re-seeding. New sprouting on areas seeded last year was also <br />noted but remains limited at this time Hydro seeded areas do not show any sigrnficant <br />growth at this time. <br />Development Waste <br />Some side cutting on <br />the west downdrain of <br />Fill 8 was noted on <br />the first bench below <br />the crest and extends <br />down to the bottom of <br />the second terrace <br />bench (see right) <br />Although limited at <br />this lime, this <br />drainage issue should <br />be repaired when <br />equipment returns to <br />the site this field <br />season <br />Overall, the site <br />appeared in good <br />condition for the <br />spring season <br />
