IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement and date of <br />abatement for the violation, previous violations still requiring abatement and the termination of violations cited <br />during previous inspections. <br />No enforcement actions were written as a result of this inspection. Previous enforcement actions that still require <br />actions are: <br />NOV CV-2002-011 was written for failure to examine at least quarterly, by a qualified person, for <br />appearance of structural weakness and other hazardous conditions. Reports are to be maintained at or <br />near the mine site and a copy sent to the Division. Act 34-33-120(2)(h)(I), Rule 4.05.9(17). This item has <br />until August 1, 2002 to be complied with. <br />NOV CV-2002-005 was written for failure to restore affected areas of surface mining in a timely manner. <br />Act 34-33-120(2)(b), 34-33-122(2)Q), Rule 4.16.1, written as a result of previous inspections, still requires <br />abatement or termination but was given a 90 day extension, to September 1,2002, in order for all <br />necessary revisions to be accomplished. <br />NOTE: Attach appropriate VIOLATIONS or CESSATION ORDER CODING FORMS <br />Revised 2/94 <br />m: icoallsh areifom~s\8101 <br />
