III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. No one represented the operator during the field inspection. <br />Facilities <br />One coal haul truck unloaded during the inspection. No rail caz loading was taking place. Quite a few <br />loaded rail cars were on site along with a loaded unit train from another mine. There were no apparent <br />problems with fugitive dust. <br />The berm on the outside edge of the facilities bench was functional. However, one small section of the <br />berm on the west side of the facilities bench, just to the east of the concrete wall needs to be built up <br />more. There were no problems noted at the fuel facility. <br />Roads <br />The haul road was in very good condition. The graveled light use road o the east side of the site and the <br />dirt light use road along the tracks were dry and in good condition. <br />Hydrolo¢v <br />The water level in the east pond was at the elevation of the primary dischazge tube. The gated valve <br />was closed and there was no dischazge from the pond. The pond embankment was well vegetated and <br />pond inslopes and outslopes appeazed to be stable. There was no water in the west pond. The small <br />slide in the hillslope neaz the west pond still needs to be repaired. <br />Ditches B and C had sufficient capacity and the four sediment control culverts were clear. Straw bales <br />and silt fence were up at the small azea exemption. There was a small amount of irrigation water <br />flowing in the private irrigation ditch on the west side of the loadout permit azea. Although the flow <br />was being duetted into one of the raikoad track culverts, no water was coming out of the culvert <br />outlet. Personnel from Bowie Resources LLC inspected the culvert and it was determined that there <br />was a gap between the pre-existing culvert and the culvert extension that Bowie Resources had <br />constructed for their track siding project. Bowie committed to repairing the culvert. <br />Topsoil Stockpiles <br />Vegetative cover on the east and west topsoil stockpiles varied from moderate to good. Collection and <br />diversion ditches berms were functional. Topsoil stockpile signs were up. <br />c:/word/terror/insp0605 <br />
