SNELTON, Director <br />October 23, 1987 <br />Mr, Robert Hagen <br />Office of Surface Mining Reclamation and Enforcement <br />Albuquerque Field Office <br />625 Silver Avenue SW, Suite 310 <br />Albuquerque, New Mexico 87102 <br />Re: OSM Ten Day Notice X-87-02-107-11 TV2 issued to Sunland Mining <br />Corporation's Apex No. 2 Mine (our file No, C-81-011) <br />Dear Mr, Hagen: <br />This letter is in response to OSM TDN X-87-02-107-11 TV2 issued to Sunland <br />Mining Corporation and received by the Division October 16, 1987. <br />On October 21, 1987 Division inspectors Thomas Gillis and Randall Price <br />conducted a follow-up inspection of the Apex No. 2 Mine and evaluated the <br />status of the alleged violations. <br />The first citation in the above TDN stated, "the mine identification sign <br />located at the entrance to the mine on Routt County Road 29 does not depict <br />the current permit number." At the time of reinspection by the Division this <br />was not a concern. A11 mine I.D. signs represented the correct permit <br />number. No enforcement action was taken, <br />The second citation was for "failure to maintain the sediment pond to prevent <br />short-circuiting" and "failure to protect the side slopes of the sediment pond <br />against erosion." An investigation of the sediment pond and diversion ditches <br />during the follow-up inspection led the Division inspectors to the conclusion <br />that no short-circuiting was occurring, nor was erosion occurring at any point <br />which would cause the sediment pond to be in non-compliance.
