Nolan MO, MPH <br />Gttviive ~IrlY1Ur <br />During the compliance sampling on October 20, 1992, it came to the attention of the Division that <br />effluent from the third settling pond flows into a previously mined area containing beaver ponds <br />before entering San Miguel River. It is at the point of discharge from the beaver ponds into the <br />river that compliance samples are taken. It is the Divisions opinion that the beaver ponds <br />themselves constitute "state waters" and as such cannot be used to provide additional treatment for <br />your process water discharge. In the future, compliance with the limitations in your permit should <br />be determined with samples from the discharge from the Final settling pond that has been <br />constructed by Telluride Gravel for the purpose of providing treatment. Your renewal permit will <br />be consistent with this requirement. <br />During a follow up inspection on November 16, 1992, it was noted that the treatment changes <br />necessary had not been implemented. Specifically, the beaver ponds continue to be used as <br />treatment and a discreet outfall from the third settling pond may need to be constructed. Please <br />provide the Division with details of the changes planned and an implementation schedule. In <br />addition, if any sampling data has been collected, please provide the Division with a copy of the <br />analytical results and an explanation of the sampling location. <br />
