Nolan MO, MPH
Gttviive ~IrlY1Ur
During the compliance sampling on October 20, 1992, it came to the attention of the Division that
effluent from the third settling pond flows into a previously mined area containing beaver ponds
before entering San Miguel River. It is at the point of discharge from the beaver ponds into the
river that compliance samples are taken. It is the Divisions opinion that the beaver ponds
themselves constitute "state waters" and as such cannot be used to provide additional treatment for
your process water discharge. In the future, compliance with the limitations in your permit should
be determined with samples from the discharge from the Final settling pond that has been
constructed by Telluride Gravel for the purpose of providing treatment. Your renewal permit will
be consistent with this requirement.
During a follow up inspection on November 16, 1992, it was noted that the treatment changes
necessary had not been implemented. Specifically, the beaver ponds continue to be used as
treatment and a discreet outfall from the third settling pond may need to be constructed. Please
provide the Division with details of the changes planned and an implementation schedule. In
addition, if any sampling data has been collected, please provide the Division with a copy of the
analytical results and an explanation of the sampling location.
