(Page 2)
MINE ID # OR PROSPECTING ID #: M-t979-99t
INSPECTION DATE: 7-25-(13 LDO
OBSERVATIONS
This was a partial inspection conducted in response to a citizen complaint. Rick Myers and Jason McGraw of
Robinson Brick Company accompanied me on the inspection.
The complaint was that Robinson Brick had removed topsoil from a portion of land where a new clay pit is to be
opened. The topsoil, according to the complaint has been pushed to within 6 feet of a neighbor's fence for
about 100 feet along the fence to a point where the fence adjoins his property. The complainant had the
understanding that a mining project must not come to within 200 feet of the adloining property.
I observed two topsoil stockpiles near the permit area boundary. The stockpile along the north permit boundary
is at least 100 feet from the property line. The topsoil stockpile along the west boundary is approximately 6 feet
from the property line. This is evidently the stockpile the complainant referred to. The topsoil stockpiles have
been vegetated by the operator and appear to be stable. The grasses planted are small but establishing very
well. No damage to the fences or property of adjoining property owners was observed.
The permit was reviewed and there is no requirement that topsoil stockpiles or any other mining related
disturbance remain any set distance from the permit boundary, which is the property line.
The 200 feet limit the complainant refers to is probably the requirement of permit applicants to identify
permanent valuable man-made structures within 200 feet of affected land, the stability of which will be
adversely affected by the mining operation. The fences of adjacent property owners and their property are not
being adversely affected by the topsoil stockpile.
I & E Contact Address
NAME: Rick Myers
OPERATOR: Robinson Brick Com any
STREET: 184.5 Worst f)nrtmouth AVP.nI IP.
CITY/STATE/ZIP: r)anvar, C(7 R0110-1308
cc: I' CE
I' BL
I' FS
I' H W
t HMWMD (CH)
T SE
t WQCD (CH)
I' OTHER- Harry Posey- DMG
I' John Navratil
