MOUNTAIN COAL COMPANY <br />WEST ELK MINE <br />1994 <br />ANNUAL CERTIFICATION OF <br />SEDIMENTATION POND MB-2R <br />This annual certification is prepared in compliance with Rule 4.05.9(10) <br />and 4.05.6(13) of the Regulations of the Colorado Mined Land Reclamation Board <br />for Coal Mining. <br />Phil Schmidt, the certifying engineer, has been working in the engineering <br />field for more than 14 years and has experience in the construction and inspection <br />of fills and embankments. He is a registered Professional Engineer in the State of <br />Colorado. <br />Sedimentation Pond MB-2R was constructed using prudent state-of--the-art <br />methods and was built in compliance with West Elk Mine's approved Mining and <br />Reclamation Plan (MRP) to retain runoff from disturbed areas.
