l <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach and David Berry of the Colorado <br />Division of Minerals and Geology. During inspection of the slump in the pit area, the operator was <br />represented by Mike Neumann and John Pellicer, both of TerraMatrix. The site was dry. <br />AVAILABILITY OF RECORDS <br />The records checklist is attached. <br />SIGNS AND MARKERS <br />The two mine i.d. signs displayed on County Rd. 53 contain the correct information. Permit perimeter <br />signs and a stream buffer sign were also properly displayed. <br />HYDROLOGIC BALANCE <br />Ditches <br />The contour ditches and the ditch that surrounds the excess spoil pile are in good condition and meet <br />design standards. The only water found in ditches in the permit area is a trickle of flow in the eastward <br />draining ditch that extends from behind the highwall area to near well HG-2, and trickle of flow in the <br />ditch at the westernmost point of the excess spoil pile. The latter ditch is carrying water from seep <br />RSP-3 and should be watched where the ditch is gullied at the entrance to pond HG-8. If erosion <br />continues, maintenance may be needed which could include additional riprap. <br />The collection ditch on the north side of monitoring well HG-2 (at the southeast corner of the excess <br />spoils pile) has thistle growing in it and otherwise lacks vegetation in places. Weed spraying and <br />seeding is recommended. <br />The ditches in the mine area that are riprapped with "red dog" are stable and dry. <br />County road drainage should be maintained so that runoff from the road is directed past the entrance <br />to the mine area. <br />Culverts <br />All five culverts in the permit area are clear, are in good condition, and do not show gullying at their <br />outlets. <br />Sedimentation Ponds <br />Both ponds are full of water and discharging. Pond HG-8 is discharging an estimated 5-10 gpm of <br />clear water. Pond 003 is discharging only a trickle of water through the three culverts that drains it, <br />but the pond is being pumped heavily for more than a dozen sprinkler heads which irrigate the shrubs <br />planted around the pond. The discharging water is clear. Both ponds' inslopes, outslopes, and <br />embankments are well-vegetated and stable, and are not gullied. <br />-3- <br />
