This inspection was performed as a follow up to an inspection conducted on August 25, 2006 to <br />evaluate the status of problems cited during the 2006 inspection. Present at the inspection were Kate <br />Pickford and David Bird, DMG. Weather at the time of the inspection was clear, calm, and <br />approximately 85 degrees. <br />2. Four problems were cited in the 2006 report. Two of the problems identified in that report have been <br />resolved, whereas two of the problem conditions remain unresolved. As stated in the two previous <br />inspection reports, vegetation on the topsoil stockpile is inadequate to fulfill the requirements of the <br />Rules and Regulations. The topsoil stockpile must be seeded within 30 days of receipt of this report in <br />order for the Operator to avoid a possible violation of this permit. <br />3. The 55-gallon drum identified in the excavation in the two previous inspection reports, or one similar to it, <br />is still located at the site. Additionally, it is located in a puddle of standing water. This barrel must be <br />removed within 30 days of receipt of this report in order for the Operator to avoid a possible violation of <br />this permit. <br />4. A bond increase was calculated relative to the 2006 inspection. The increase amounted to $43,059.00 <br />more than the previous bond amount. $20,264.00 of the increase is related to removal of tires that are <br />located within the permit boundary. The Operator has indicated that these tires belong to the <br />landowner and the Operator does not want to post bond for removal of these tires. The Division has <br />inspected the area in which the tires are contained and determined that there is no mining-related <br />disturbance in this area of the permit. <br />5. In order for the Operator to be absolved of financial responsibility for removal of the tires the Operator <br />must submit an acreage reduction and a surety reduction request to the Division to have the <br />undisturbed acreage containing the tires removed from the permit area. In order for the Division to <br />process these requests, the site must be in compliance with regard to the topsoil seeding and removal <br />of the 55-gallon drum. Once this request is received and processed by the Division, the required bond <br />amounf will be reduced by $20,264.00. The remaining difference of $22,795.00 bond will need to be <br />submitted to the Division in order to comply with the permit. Alternatively, the Operator may conduct <br />partial reclamation that would reduce the required bond amount by the increased amount.
