(Page 5) <br />MINE ID # OR PROSPECTING ID # M-1967-028 <br />INSPECTION DATE 09/28/04 <br />INSPECTOR'S INITIALS ESC <br />The following problems (PB) and/or possible violations (PV) (and suggested corrective <br />actions) were identified during this inspection. The problems should be corrected by the <br />dates given, or they will become possible violations. The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land <br />Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEMS/POSSIBLE VZOLATIONS <br />AND <br />1'~ PROBLEM: <br />PB or PV:PB ~ <br />The Lily Mines permit was approved for 9 acres in size, but data <br />collected by the Division indicate that the site is TOPIC(S):OD ~{'~ <br />approximately 20 acres in size. This is a possible violation of 12/01/04 <br />34-32.5-116 (4)(I)or 34-32.5-109(1). <br />CORRECTIVE ACTION: <br />Submit a complete 112 Conversion Application by December I, 2004 <br />and have the application approved by March 1, 2005 (or April 1, <br />2005 if comments are received). <br />PROBLEM: <br />2.~ C.R.S. 34-32.5-116(1) of the Colorado Land Reclamation Act for <br />the Extraction of Construction Materials requires that the <br />operator perform the reclamation prescribed by the mining and <br />reclamation plan. The approved mining and reclamation plan does <br />not reflect the current disturbance noted on site. Specifically, <br />the operator has mined greater than 40 feet high as initially <br />proposed and created a waste pile within Taylor Gulch. <br />CORRECTIVE ACTION: <br />The operator will need to address the extent of mining and the <br />waste pile noted on site in the mining and reclamation plan and <br />specify reclamation measures that meet the performance standards <br />of Rules 3 and 6. <br />PROBLEM: <br />3' Placement of the waste pile in Taylor Gulch and use of the gulch <br />to collect waste fines may be a violation of C.R.S. 34-32.5- <br />16(4)(h) and Rule 3.1.6 which states that disturbances to the <br />hydrologic balance of the affected land and of the surrounding <br />area and to the quantity or quality of water in surface and <br />groundwater systems both duing and after the mining shall be <br />minimized. <br />CORRECTIVE ACTION: <br />The operator will need to design and construct a sediment <br />containment structure to prevent further disturbances of the waste <br />fines from moving off site. In addition, the operator will need to <br />design and construct a drainage channel to redirect Taylor Gulch <br />away from the disturbed site. The designs for the sediment pond <br />and drainage channel will need to be included in the 112 Conversion <br />Application <br />PB or ~: PB <br />TOPIC(S) :PP1/BG <br />12/01/04 <br />PB or ((PVC~ PB <br />TOPIC (3`) :HB <br />12/01/04 <br />
