This permit does not yet have a spill reporting stipulation. This is being addressed universally by the Board, and <br />may be required at some future date. Meanwhile, spillage is regulated under a CDPHE SPCC. <br />Synthesis/Conclusions, <br />Mr. Stratton explained that prior to my inspection, he queried his staff regarding the received the complaint <br />letter and the spill, and no one had any recollection of such a spill. <br />Occasional minor spills of fuels and other operation and maintenance fluids are anticipated at all mine sites <br />that have on-site fluid storage or that do fueling or maintenance on site. The secondary containment tanks <br />around the fuel tanks are designed to handle tank ruptures, and are adequate for secondary containment. <br />The sand filter beneath the small volume fluid storage area is adequate provided it is maintained and cleaned <br />out when large volumes escape. None of these secondary containment means are anticipated to prevent all <br />spillage. <br />In areas where space and soil materials are available, and where spills are significantly above local water <br />tables, it is considered acceptable to manage fuel spills by spreading out the fuel then plowing or disking it for <br />aeration whereupon it is presumed that the material will volatilize. To prevent access to animals, anti-freeze, <br />which is poisonous but attractive to some wildlife, should not be left uncovered, and spills should not be <br />allowed to pool up. <br />The observed spills at the Church pit are of small volume and are considered an acceptable and minimal <br />consequence of the excavation work. While the Division has no reason to question the accuracy of the <br />complainant's report, if a large volume spill did indeed occur, and if it was handled as reported, that handling <br />procedure probably would have been considered acceptable handling practice. <br />All other aspects of the inspection and records review were found to be in compliance. <br />This inspector finds no problem at this site. <br />For information on this inspection, please contact Harry H.
