III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear represented Bowie <br />during the field inspection. There had been precipitation over the weekend but the mine site was fairly dry. <br />Main Mine Site <br />The paved main haul road was in good condition. The operator recently repaved the section of road above the B- <br />seam portal bench. Guard rail and concrete barriers were in place. The mine ID sign was up at the entrance and <br />contained the required information. There was a large amount of stockpiled coal on the coal stockpile bench. <br />The coal was piled right up to the containment berm top but no coal was going offsite. Pond B had a fair amount <br />of standing water in it. The pond spillways were functional and the pond embankment was stable. <br />The main topsoil stockpile had a good vegetative cover. There were no indications of erosional problems and the <br />topsoil signs were up. There also were no erosional problems at the B seam excess material storage stockpile. <br />The cross ditches on top of the stockpile were in place and the rock outslopes appeared to be stable. There was a <br />fairly lazge volume of stockpiled coal on the D seam portal bench. There were no problems with the facilities on <br />the D seam portal bench and at the wash plant at the bottom of the hill. <br />Coal Waste Stockpile <br />The gob pile haul road was in good condition. The road berm was in place, as were the road ditches. Straw bales <br />were properly placed in the road ditches. The material storage areas along the gob pile road were orderly. There <br />was a moderate amount of water in pond C while pond D had no standing water. <br />The operator was placing coal waste at the western extension area of gob pile no. 2. Above the area of coal <br />waste placement, the operator was excavating soil material to be used as cover material for the coal waste and to <br />provide additional room for coal waste. The excavated soil material was being stored at a temporary stockpile <br />next to the gob pile. On the east side of gob pile no. 2, small piles of damp coal waste were drying out. There <br />was no activity in the central part of gob pile no. 2 or at gob pile no. 1. The upland diversion ditches for the <br />entire gob pile area had sufficient capacity. The gob pile had positive drainage and the gob pile outslopes were <br />stable. Surface disturbance markers were up around the disturbed area. <br />Hubbard Creek Vent Shaft <br />Construction continues at this site. A lot of the excavated boulders were broken up and placed in a temporary <br />storage area at the intersection of the Hubbard Creek road and the Freeman Gulch road. The upland diversion <br />ditch has been constructed and riprap has been placed in the steeper southern section of the ditch. On the north <br />end of the site, broken boulder pieces have been placed against the hillside just below the upland diversion ditch <br />Some rocks are being crushed and sized for gravel. The topsoil stockpile is near the south end of the site, away <br />from the current construction activities. The topsoil stockpile could use more silt fence and the topsoil signs still <br />need to be put up. The sediment control for the shaft site area includes silt fence, which was properly installed. <br />Exploration Drill Sites <br />The drill pad for exploration drill hole SS-4 has been graded to approximate original contour and is being <br />covered in erosion control blankets. The pad for SS-3 has not been drilled yet and has been prepared for winter. <br />Silt fence was up and the mud pit was protected with fence.
