Barry, 111, <br /> Director <br /> MEMORANDUM <br /> TO: File <br /> FROM: Roger Funston <br /> DATE: November 14, 1978 <br /> RE: Nottingham Sand & Gravel - Adequacy Concerns <br /> Our File No. 77-343 <br /> On November 14, 1978, 1 had a phone conversation with Mrs. Petre of <br /> Petre, Zimmerman and Shelton, the law firm preparing the mining <br /> and reclamation application for Mr. Nottingham. I stressed the neces- <br /> sity of going forward in the application process. Processing of this <br /> application has been stalled for nearly a year, primarily because of <br /> problems associated with this operation obtaining county approval . <br /> Because of this, no attempt has been made, until recently, in addres- <br /> sing the remainder of the adequacy concerns raised by the Mined Land <br /> Reclamation staff. Mrs. Petre expressed willingness in solving <br /> remaining concerns so that this application can be presented to the <br /> Board in early 1979, hopefully January. <br /> During our conversation, Mrs. Petre and I discussed answers to many <br /> of the questions raised in adequacy letters of January 10, 1978 and <br /> September 11 , 1978, and what additional steps must be undertaken for <br /> the application to be considered adequate. A summary of this discussion <br /> follows with answers keyed to the question number of the above-referenced <br /> adequacy letters. <br /> (1) Information in the application (Exhibits D & E) explains how <br /> mining will proceed. Overburden from the area being excavated will <br /> be used as fill to backfill the pit just east. Therefore, no over- <br /> burden will be stockpiled. <br /> (2) Reclaimed slopes will not exceed 2: 1 (horizontal to vertical) . <br /> Reclaimed slopes will be irrigated. <br /> 13) The reclaimed area will be fertilized if necessary according to <br /> the results of soil tests performed after final grading and prior <br /> to seeding. <br /> :14_) 'Topsoil salvage measures, if any, are still not clear to the staff. <br /> Further explanation would be helpful . <br /> (5) The settling pond will be filled in after reclamation is complete <br /> and the former pond area will be seeded with the proposed seed mixture. <br /> (6) Mrs. Petre is preparing a response to concerns raised by the Division <br /> of Water Resources. <br /> (7) The soils and vegetation information presented in the application <br /> in Exhibits I & J is satisfactory. A Soil Conservation Service report <br /> will not be necessary. <br /> (8) The difficulties concerning local government approval should be <br /> resolved as soon as possible.
