III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Reclamation, Mining and <br />Safety. No one represented the operator during the field inspection. <br />West Mine <br />The backfilled and gaded former portal bench area appeared to be stable. There were no erosional gullies and <br />no evidence of slumping or cracking. There was a moderate vegetative cover on the slopes. The two sediment <br />ponds had only a little water in each of them. Pond embankments were stable but did not have much of a <br />vegetative cover. Spillways were functional. The mine 1D sign was present and surface disturbance markers <br />defined the disturbed area. The road to the site was in very good condition. <br />East Mine <br />The front gate to the mine site was closed and locked. The paved haul road and dirt access and light use roads <br />were passable and in good condition. The two topsoil stockpiles on the utility bench were vegetated and had <br />their topsoil signs up. The upland diversion ditch was welt vegetated and had enough capacity. The various <br />bench cut and fill slopes appeared to be stable. Some metal was removed from the substation for salvaging. <br />Surface disturbance markers were up around the site. The west ridge waste pile was well vegetated and showed <br />no slope instability. Terrace ditches were functional. The waste pile pond was dry and spillways were <br />functional. The last bin wall pond, the NPDES point, was dry and the gated valve was closed. <br />Well Field <br />The road leading into this site was muddy but passable. The mine ID sign and surface disturbance markers were <br />present. The topsoil stockpile had a good vegetative cover. Two topsoil signs were up on the stockpile. <br />Run-Of--Mine (ROM) Stockpile <br />The graveled haul road leading into this site was in very good condition. The mine ID sign was up at the <br />entrance and surface disturbance markers defined the disturbed area. There was no standing water on top of the <br />pile. There was a small amount of standing water in the sediment pond. <br />Hiehway Coal Stockpile <br />This site had the coal removed and, then, was covered in dirt and vegetated to cut down any dust. The road <br />leading to this site was passable. The mine ID sign and surface disturbance markers were up. There was standing <br />water in the sediment pond, about five feet below the excavated pond top. The straw bales were in place around <br />the inlet of the west side culvert. The cut slopes were stable. Some of the railroad track has been dismantled. <br />Unit Train Loadout <br />Reclamation of the structures continues. Steel is being cut up and concrete being broken up for removal. <br />Documents Received <br />The operator gave a CD containing pictures of the loadout reclamation.
