. - <br /> <br />MINE SITE EVALUATION INSPECTION REPORT PAGE 6 <br />~:~ Bhio Creek #2 <br />GENERAL COMMENTS <br />Sylvia McCormick <br />Ohio Creek Coal Company <br />3567 South Dawson Street <br />Aurora, Colorado 80014 <br />The Office of Surface Mining (057) conducted a complete oversight <br />inspection of the Ohio Creek #2 mine on May 24 acrd 25, 1983. Ten-Day <br />Notice No. 83-2-0-1 was issued for two violations and is the subject <br />of the following discussion. <br />A review of the records available at the mine indicated that the per- <br />mittee was not in compliance with the State's requirements for main- <br />taining such records at a convenient place in the vicinity of the <br />mine. Records that were unavailable for revie•d at the mine during the <br />inspection included the permit approval document, the water monitoring <br />analyses, the SCS reclamation plan, the federal lease, and the pond <br />certification. Mr. Tom McCormick, owner/operator, was advised of the <br />problem and and its inclusion in a Ten-Day Notice. In conjunction <br />with the subject of the permit approval document, discussions with the <br />Colorado Mined Land Reclamation Division (NERD) included the status of <br />a filing of succession of operator forms to reflect the new operator <br />and the mining permit transfer. In addition, the entrance identifica- <br />tion sign should be changed when the permit transfer is complete. <br />Continuing discussions with the MLRD will complete this information. <br />During 'the inspection of the disturbed area, erosion of the lower <br />bench outslope was observed. The erosion was caused by a breach in <br />. the berm along the outer edge of the lower bench. No surface flow was <br />evident during the inspection. Two similar drainages were located on <br />either side of the erosion channel but were reinforced somewhat with <br />concrete inlets and shaker pans. Mr. McCormick was advised of the <br />violation and the fact that it would be included in a Ten-Day Notice. <br />The Ten-Day Notice was issued on May 31, 1983. Discussions with the <br />MLRD have taken place in regard to the conditions noted and will con- <br />tinue upon receipt of the State's response. No other violations were <br />observed. <br />
