III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of DRMS. No one else was present <br />during the inspection. The ground was dry. Photographs taken during the inspection aze attached. <br />A recent Minor Revision approved use of the pond for storing water produced from coalbed methane <br />wells outside the permit boundary, but there was no indication on the site that this activity has <br />occurred. <br />Records Availability <br />Records were checked at the Garfield County courthouse (see attached checklist). All required records <br />were on file with the exception of a current liability insurance certificate and a copy of the Apri12007 <br />DRMS inspection. <br />Siens and Markers <br />The mine i.d. sign was in place at the entrance gate next to the I-70 frontage road. <br />Roads <br />Road surfaces were in good condition. <br />Hvdroloeic Balance <br />Both cells of the sediment pond were dry. Pond inslopes appeared stable. <br />Backfill and Grading <br />Backfill appeazed stable in the azea of both portals. <br />Support Facilities <br />No problems were found on the upper, middle, or lower terraces. <br />General Mine Plan Compliance <br />No problems were found on the site. <br />ReveEetation <br />The site has substantial, diverse vegetative cover of grasses and woody shrubs. No weed problems <br />were found. <br />3 <br />
