III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Reclamation, Mining and <br />Safety. Jim Kiger represented the operator. The local area had received over a foot of snow recently. The <br />facilities area was mostly clear of snow but was wet. The grassy areas had 4 to 6 inches of snow cover. <br />Signs and Markers <br />The mine ID signs were up at the main entrance, east entrance and down by the railroad tracks. All three mine <br />ID signs contained the correct information, including the new street address. <br />Facilities <br />During the inspection, a front end loader loaded one coal haul truck for transport and one coal haul truck <br />emptied its coal load. Also during the inspection, wal railcars were being loaded. In spite of these activities, <br />there was no indication of any fugitive dust going offsite. <br />On the facilities bench, there were no problems at the fuel facility, the weigh station and the loading structures. <br />The berm on the outside edge of the facilities bench was in place. No problems were observed at the mine office <br />and shop area as well. <br />Roads <br />The main paved entrance road was in good condition. The guard rail was in place along this road. The east side <br />entrance road was snow covered but plowed. The snow covered light use road adjacent to the railroad tracks was <br />not plowed but was still passable. <br />Hydrology <br />The eastside sediment pond was snow covered but there was a small amount of frozen snowmelt in the pond. <br />The primary discharge tube gate was in the closed position. The westside dugout pond was snow covered as <br />well. <br />llitches and culvert inlets and outlets were covered in snow. The straw bales and silt fence at the railroad small <br />area exemption were partially covered in snow but were in place. <br />'Topsoil Stockpiles <br />The east topsoil stockpile was completely covered in snow. The topsoil signs were up. The west topsoil <br />stockpile was also covered m snow, except Yor the south tacmg slope.
