III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDMG. No activities were occurring <br />on site as the mine has been backfilled, graded, mulched and seeded. The landowner, Mr. A.J. <br />luppa was present during portions of the inspection and provided access to the mine site and to <br />the records. The Trinidad area has been experiencing a drought, but had received approx 1.3" of <br />rain on 6/15/96 according to the landowner. <br />Records: Records were checked in the mine offce. DMG Availability of Records form <br />accompanies this report. The landowner has been keeping a log DMG and Energy Fuels <br />personnel visits to the site. This log shows that the engineer visited the site on June I5, 1996. <br />Coal Processing Waste Btutk (RDA) and Quarterly Pond Inspection both conducted on March 20, <br />1996 were performed by a different engineer than Energy Fuels has used previously. Mr. Santiago <br />Romero Jr. performed the first quarter pond and waste bank inspections. The bond document ltas <br />not been updated since the three bond release approvals in 1995 and 1996. /f additional riders <br />been issued for the bond, these need to be filed with the public records. <br />Signs and Markers: Mine I.D. sign is posted at the entrance to the mine from the frontage road. <br />Appropriate information is contained on the sign. Disturbed area perimeter markers were observed <br />on the mine site. Mine I.D. signs have been removed at the Santa Fe loadouts as advised in the <br />February 13, 1996 inspection report. Loadouts !rave been released from the permit area. <br />Hydrologic Balance: Mine site was dry. Road side ditc{tes are in good repair with no sign of <br />downcutting or sediment deposition. <br />Topsoil SAE has a heavy stand of yellow sweetclover with an occasional wheat plant. Although a <br />few Agropyron sp. were found, the yellow sweetclover is dominant almost to the exclusion of other <br />species. Tfte silt fence at the Topsoil SAE has been repaired. A section of fence has been <br />removed from the NW comer, yet additional silt fence ltas been installed upslope of the removed <br />section. No rilling or sediment deposition was noted at t{:e Topsoil SAE. <br />Some rilling has occurred on the access road to t/te sediment pond. Of concern is rilling where <br />the road curves north. Some undercutting of the Reno mat has initiated. The operator needs to <br />assure that undercutting does not progress. RDA ditch 1 is in good repair with tl:e exception of <br />fire undercut location noted above. Starkville Gulch Diversion is in good repair with no sign of <br />scouring or other damage. RDA ditch 2 remains in good repair as well <br />The sediment pond contains water approximately 5" below primary spillway discharge point. <br />Primary spillway is clear and trash rack is free of debris. RDA underdrain is discharging into the <br />pond at a very slow rate, <I/, gpm approx. Water in the pond is extremely turbid. Goldfult are <br />present in the pond but are staying close to the surface. <br />CWD#1 remains in good repair. No problems observed with CWD#2, #3, or #5. CWD#5 has <br />considerable concentration of cocklebur on the embankments. Culverts are clear and functional. <br />Some sediment remains within the Starkville Gulclt diversion culvert but this amount should not <br />interfere with flow though the 8 ft. culvert. <br />
