• • (Page 2) • • MINE ID # OR PROSPECTING ID # M-96-052 ~INSPHCTION DATE 9-18-96 INSPECTOR'S INITIALS GSC OBSERVATIONS This was apre-operation inspection conducted with Mr. Gary Hardin of Owens Brothers Concrete Company. This site consists of 105 acres currently used for farming. Harold, Blake and Bob Nelson, who own land southwest o£ the permit area, stopped by and discussed the project. Harold said there is a well located at the farm house due west of the southern tip of the permit area (approximately within 600 feet of Phase 3). Their interest in the project was mostly related to groundwater issues and potential impact to the nearby wells. A portion of the permit is situated in the 100 year floodplain of St. Vrain Creek. If topsoil stockpiles will be located in areas prone to flooding, they may be subject to potential erosion from flooding. The operator will be asked to address this issue during the review of the application. There are two residences north of the permit boundary. Gilbert Acord owns the property to the northeast. There is a well and spring located on this property. An old school house located to the northwest may have a well (Timko property). Pursuant to Rule 3.1.6, disturbances to the quantity and quality of groundwater must be minimized during the operation of the mine. During the application review, the operator will be required to address this issue. ~~ There are several structures on-site, or off-site within 200 feet of the affected area. `,These include an oil/gas well, Sinclair Pipeline, Last Chance Ditch, weld County Roads, Seep Drainage Ditch, an irrigation ditch south of the Seep Drainage Ditch, an irrigation lateral extending from the Last Chance Ditch northward across the central portion of Phase 2 which crosses County Road 26 3/4 and enters the land to the north, and power lines. The operator will need to provide notarized compensation agreements with the owners of these structures or demonstrate that the operation will not adversely affect the stability of those structures. This has been completed for some structures. .., Wetland areas were observed along the eastern aide of the permit. These were identified by the operator in the application. Pursuant to a letter from the Army Corps of Engineers dated August 6, 1996, the operator will need to contact that agency to determine if a Section 404 permit or survey for Spiranthes diluvialis will be required.
