III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Seneca II Mine conducted on October 19, 2004 by Mike <br />Boulay of the DMG. Robert Shevling of Seneca Coal Company (SCC) was present during the <br />inspection. Weather conditions were cloudy with intermittent rain. It began raining hazd towazd <br />the end of the inspection. Ground conditions were wet and the mine site was partially snow <br />covered. Other than the use of the shop and truck wash facilities, there was no activity at the <br />mine site. <br />Roads <br />Road surfaces site wide were wet and muddy. Access to the site was limited to the two bone <br />yazd azeas, the shop/facilities azea, and the permanent_road accessing the Upper Wolf Creek azea. <br />The permanent access road became impassable beyond the location of the Wadge Pasture. Water <br />was flowing in the road ditches along the access road. Road ditches appeazed to be stable with <br />no significant signs of erosion. All other mine site roads were impassable due to very muddy and <br />slick conditions. <br />Hydroloeic Balance <br />Pond 002 and the Truck Wash Ponds were the only sedimentation ponds inspected. Pond 002 <br />was discharging a small amount of cleaz water at the time of the inspection. The Truck Wash <br />Ponds were retaining water but not dischazging. The Pecoco Pond was viewed from above on <br />the access road. This pond was full up to the principal spillway. Ponds 004 and 008 could not be <br />viewed from the access road. No problems were noted at any of the pond locations. <br />Fish & Wildlife <br />The sharp-tailed grouse lek located in the Wadge Pasture azea was viewed. Approximately 15 <br />grouse were observed in the general vicinity of the lek. <br />
