No <br /> waiver, release or extension of time for performance of any obligations hereunder, or <br /> of any right or default, shall be binding against a party, or be admissible in evidence <br /> against a party in any action brought to enforce any provision hereof, or for damages <br /> by reason of an alleged default of any obligation hereunder, unless such waiver, <br /> release or extension is contained in a writing signed by such party. <br /> 12.Notices. Kluksdahl <br /> General Manager and Vice President <br /> Notice shall be given (a) by personal delivery to the other party, or (b) by electronic <br /> communication, with a confirmation sent by pre-paid certified U. S. mail, return receipt <br /> requested, or (c) by pre-paid certified U. S. mail, return receipt requested. All Notices <br /> shall be effective and shall be deemed delivered (a) if by personal delivery, on the date <br /> of delivery, (b) if by electronic communication, on the date of sending and (c) if solely by <br /> U. S. certified mail, three (3) business days after mailing. A party may change its <br /> address by Notice to the other party. <br /> 13. Recording of Agreement. This Agreement may be recorded in the real property <br /> records of Teller County by either party. <br /> 14. Specific Performance. The parties hereto and Cripple Creek or Victor shall have <br /> the right to enforce specific performance of this Agreement and to injunctive relief. <br /> 4 <br />
