III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. "fhe comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the operator during <br />the field inspection. Bill Bear represented the operator during the records check. <br />Signs and ;.;esker <br />The mine [D sign was on the post at the top of the hill but the post was knocked down. The post should be put back up. <br />Surface disturbance markers were un around the disturbed area. <br />Roads <br />The paved haul road was passable and in good condition. The guard rail was up. The bridge was also passable. <br />Facilities <br />The entrance gate to the mine site was closed and locked. The "no trespassing" sign was up on the gate. There were no new <br />problems with the dilapidated mine office building. <br />Hvdroloev <br />The spring water treatment pond was discharging at about 15 to 20 gpm. The discharge was the usual dark orange color, <br />which has been found to he m compliance. The water level in the pond was about 8 inches below the horizontal pipe. Pond <br />inslopes and outslopes were stable. The water level in the sediment pond was about 2 feet below the invert of the primary <br />discharge tube. The tube gate was closed. The pond embankment was stable and well vegetated. Pond inslopes were stable. <br />The collection ditch leading into the north side of the sediment pond was well vegetated and had sufficient capacity. The <br />culvert at the entrance to the mine site was clear. The caps on both of the alluvial wells were on. No water was ponded <br />azound either well. <br />The east side spring was flowing. The spring water temperature was measured as 104 degrees Fahrenheit at a point 10 feet <br />below where it comes out of the hillside. Some of the hillside has shifted so that most of the spring water is flowing a few <br />feet more to the west, rather than the usual path just to the east. <br />Noxious Weeds <br />There was some tamarisk along the west side fence, at the water's edge in the spring water treatment pond and, especially, <br />around the east side spring. The tamarisk needs to be removed. <br />Reclamation <br />The reclaimed portal road was stable and well vegetated, as was the reclaimed east side fan site. However, the west portal <br />site continues to show instability. There are some features that appear to run in a line and might be related. The hole in the <br />cliff about 30 feet above the backfilled workings has grown larger and has two cracks in the rock above and below it. The <br />hole and cracks are in line with an expanding and deepening sink hole behind a large rock that is at the base of the cliff. All <br />ofthese are in line with a 6 foot diameter low spot near the base ofthe cliffand has been apparent for several years. This <br />general area is about 20 feet to the east of the location where cracks had appeared some time ago. These earlier cracks have <br />continued to fill in. <br />Records Check <br />The records were in compliance, as documented oo the attached records checklist <br />c:/word/bear3/insp 1006 <br />
