The County
representatives indicated that this matter had been researched, in response to the corrective
action required by the Division, and that the adjacent landowner identified in the permit
application as Margaret Munro was in fact Charles Shows at the time of the application. The
County was requested to report the result of their research in writing to the Division by the
corrective action date of January 20, 2000, as specified in the inspection report. The
County was advised during this discussion that the matter had been sent to the Attorney
General's Office for evaluation and recommendation. This compliance problem will be repeated
on Paae 4 of this report since it remains unresolved at this time.
Compliance Problem 2, identified during the Division's December 16, 1999 inspection, relates
to the County complying with its permit commitment to institute measures to protect the
quality of the local surface water from the effects of runoff from the permit area.
Inspection of the San Acacio Pit revealed that the County had installed a hay bale silt
barrier on its property near the entrance to the CDOT culvert toward which most runoff from
the permit area appears to drain. This will satisfy the corrective action requested by the
Division to abate Compliance Problem 2.
Cc: Mr. Kenneth Hershey
HCR 30, Box 12
Mesita, CO 81152
I & E Contact Address
^ CE
NAME: Ms. Elizabeth Pacheco, County Administrator ^ BL
OPERATOR: Costilla County ^ FS
STREET: P.O Box 100 ^ HW

CITY/STATE/ZIP: San Luis, CO 81152 [~ HMWMD (CH)
^ SE
^ WQCD (CH)
OTHER (EPR~
(~~l
CEriTIFIED MAIL NO. z 3 ~3~ ~ ,
RETURN RECEIPT REQUESTED
