Dear Mr. Zigan:
Thank you for your letter of December 22, 1995 in reply to Mr.
Curtiss's report of an inspection conducted on September 28, 1995.
After reading your comments, I reviewed the permit and Mr.
Curtiss's inspection report for the above referenced operation and
have the following reply.
Your letter states that you did not receive Mr. Curtiss's
inspection report until December 15, 1995, leaving you seven days
to complete the corrective actions. As we discussed during our
telephone conversation of December 26, 1995, the Division can
understand your frustration in such a case.
I noticed on the inspection report that copies of the report were
also sent to several other parties. After checking these parties,
I found that you were the only one who did not receive a copy of
the inspection report in a timely fashion. For example, Sarah
Johnson of the Water Quality Control Division, Colorado Department
of Public Health & Environment, received her copy of the report on
October 25, 1995. We will make an effort to ensure that this does
not happen in the future. We will also adjust the due dates for
corrective actions to reflect reasonable time frames to achieve
these.
My remaining comments pertain to your item by item response to the
possible problems and violations noted in the inspection report.
