This will require <br />suitable protection. <br />Hydrology <br />Rule 3.02.2(2) requires that the Division make a "determination whether pollution of <br />surface or subsurface water is occurring, the probability of continued pollution, and <br />the estimated cost of abating such pollution". The Division has made a negative <br />determination that water pollution is occurring or will occur. The Division bases this <br />findings on the operators proper implementation of designs, maintenance, and <br />monitoring as approved in the permit application. All ponds are designed, at a <br />minimum, to contain and treat surface runoff from a 10 year, 24 hour event. All <br />runoff from disturbed areas pass through these treatment systems. Past NPDES <br />monitoring do not show that pollution is occurring. The Division does not expect that <br />there will be groundwater pollution. There is no toxic overburden to cause water <br />pollution. This past winter, prior to backfilling the 720 pit, water had to be <br />discharged under an industrial discharge permit. This water was a mixture of surface <br />run-off and groundwater that had been in contact with spoils for many years. <br />Bio-monitoring of the discharged pit water met NPDES water quality standards. <br />Marr Strip, Bond Release 4 May 24, 1994 <br />
