111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology (Division). This former mountaintop removal operation is now reclaimed and <br />has achieved a Phase I bond release for most areas. Ground conditions on this day were <br />dry and the weather was unseasonably warm. Bobby Steele, representing Lorencito Coal <br />Company, accompanied me on the inspection. <br />Roads <br />The second culvert ascending the Jeff Canyon haul road requires additional cleaning from <br />recent storm runoff. Sediment build up in the culvert itself should also be removed. was <br />partially blocked with sediment due to summer storm runoff. This culvert should be cleared <br />prior to the next CDMG inspection. <br />The operator has begun efforts on the reclaimed area to relocate the permanent road <br />through the disturbed area. So far, work has only been completed in areas where topsoil <br />has not been re-applied. The operator will submit a revision to the permit requesting road <br />relocation and re-alignment. This revision will allow for drainage control improvements at the <br />location of the current roadway, where frequent maintenance is commonplace. <br />Hydrologic Balance <br />The gas line crossing above pond 8 was inspected. Mr. Steele and I discussed potential <br />work here to prevent additional erosion from jeopardizing the gas line. The operator will <br />implement improvements and repairs below this culvert to protect the culvert and gas line <br />prior to the next State inspection. Some modification to the light use road drainage above <br />this location may also be necessary. <br />The ditch starting at the southeast corner of the "center core" should be cleaned of sediment <br />along its entire length to restore necessary freeboard and prevent overtopping. <br />Excess Sooil and Development Waste <br />Fill 7, Fill 8, and Fill 9 all appeared normal with no sign of slumps, slides or damage of any <br />kind. <br />Overall, the site appeared in excellent condition for the late summer season. <br />3 <br />
