COMMENTS -COMPLIANCE ~~//y ~ ~(// D/) <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Deserado Mine conducted by Jim Stark of CDMG. <br />Scott Wanstedt of BME accompanied me on the inspection. The mine was actively <br />producing coal and hauling refuse at the time of the inspection. The Division has <br />approved Permit Revision 04, which will become final after the public comment <br />period. The weather was cold and overcast and the ground was covered with <br />several inches of snow. <br />Signs and Markers: All of the necessary signs (including the mine ID signs, permit <br />boundary signs, refuse pile ID signs, subsoil stockpile signs and topsoil stockpile signs) <br />were properly displayed and in good condition. <br />Roads: The access road to the mine site is a paved road. The road was well <br />maintained and in good condition. <br />-The haul road to the refuse piles (RP-1, RP-2/3/4 and RP-Sa) was wet from the recent <br />snow, however, it was well maintained and in good condition. The road appeared <br />stable and there were no signs of erosional problems. <br />-The access road to two drill pads under NOI X-2003-142-08 was becoming rutted <br />due to the muddy conditions. This road will need to be regraded and returned to its <br />original condition after the drilling has been completed. <br />Hydrologic Balance: -Pond RP-2/3 contained a very small amount of water. Both of <br />the cells at the pond inlet also contained a small amount of water. The pond <br />embankment was well vegetated and appeared to be stable. There were no <br />erosional problems noted on the pond embankment. <br />- Pond DP-l contained water at a level just below the discharge pipe. The pond was <br />discharging at the time of the inspection (through a small decant pipe just below the <br />principle spillway). The pond embankment was well vegetated and appeared to be <br />stable. There were no erosional problems on the pond embankment. The <br />emergency spillway was well maintained and stable. <br />-The roadside ditches along the mine access road and the haul road to the refuse <br />pile appeared to be stable and well maintained. <br />Processing Waste: -Refuse Pile RP-2/3/4 was not being actively worked at the time of <br />the inspection. The pile was covered with snow at the time of the inspection; <br />however, no problems were noted with respect to the pile. <br />-The Operator was dumping refuse on pile RP-5a at the time of the inspection. There <br />were approximately 40 piles that need to be spread and compacted. Scott was <br />unsure if they were beginning the stockpiling operations at this time or just waiting to <br />spread the refuse until it could dry more (as it has been very cold the past several <br />days). The pile was covered with snow at the time of the inspection. Due to the wet <br />weather, there were no problems with fugitive dust. <br />
