This area was included in the permit area of the original mined land <br />reclamation permit, but was excluded from [he area of affected lands (reference map Exhibit C from the original mined <br />land reclamation permit application). In order to include the area Duckels wants to [nine into the area of affected <br />lands, a permit amendment is required. Section 34-32.5-1 i2(7)(a), Colorado Revised Statutes states, in part: <br />An Operator may, within the term of a reclamation permit, apply to the Board or the Office for a reclamation <br />permit amendment to increase the acreage to be affected or otherwise revise the reclamation plan. An <br />application for the amendment of a reclamation permit shall be reviewed by the Board or Office in the same <br />manner as an application for a new reclamation permit. <br />So with d1e amendment application, you will submit the same exhibits as you would for a new application, except that <br />you are not required to duplicate any exhibits that were in the original application and have not changed. For example, <br />the c{imate information required as exhibit K will not have changed from the original permit, so you will simply refer <br />to exhibit K in the amendment application and slate "no change from original application." <br />Enclosed with this letter is a stack of reclamation permit application Forms for your use.
