Compliance with Colorado Sur `acs Coal Yining Reclamation Act <br />CRS 1973, as amended JJ-33-101, et. se ., <br />a.:d c.Se <br />Ruses and Recula ti ons issued Pursuant to the Act <br />This includes a listing of the particular provisions of the reculatory program which were <br />examined during the course of t~.is inseection, and identifies enforcement actions taken <br />duri^g the inspection for failure to comply with GSe Rules and Regulations, the Act and <br />the permit. <br />4.02 Signs and Markers <br />The required additional perimeter markers were not up yet. The abatement dead- <br />line was April 24, 1981. <br />4.03 Roads <br />Road maintenance appeared to be somewhat lacking. Drainage ditches along the <br />roads were filled in, in many places, and drainage at the coal stockpile area <br />was in a state of disrepair. <br />9.05 Hydrologic Balance <br />1. The diversion ditch from the mine bench to pond y2 was breached on the Lower <br />part of the slope. This is a continual problem. The operator must take measures <br />to construct this ditch according to the approved design by June 12, 1981. <br />2. The outlet to the sediment pond/reservoir was partially clogged ~.~ith willow <br />stems. It was explained that muskrats continuallu fill this up. Since this is <br />a continual problem, the operator must submit a plan to the Division to keep this <br />open by June 8, 1981. <br />J. Trash on the first switchback below the mine hench was not cleaned up and .LL~ <br />the haul road culvert, where drainage enters the ditch to pond b2 was not cleaned. <br />Notice of Violation (NOV) N81-Z7 was written because of these problems. This <br />must be remedied by June 8, 1982. <br />9. The culvert at the coal stockpile area must be repaired by June 8, 1981 and <br />the ditch system should be regraded. <br />5. The pond near Hubbard Creek, and North of the road, must be completed by <br />June 29. 1981. <br />4.12 Slides and Other Dama <br />The outer ecrtion o_` t`;e ,,^..ine beach had slumped. There Here tension cracks <br />throuchout the face and top r: hic;~ showed that the whole face of the mine bench <br />is unstable. The operator was actic•elu backfilling the slump area and in the <br />process was dumpinc material from the tee of another slump, at the face-u p, over <br />the embankment. NOV 81-18 was written for failure to prevent spoil material <br />from being placed on the doi.-nslope of the mine bench. The operator must submit <br />a plan to the Division to stabilize the mine bench slope by July 20, 1981. <br /> <br />
