It appears from your-inspection report that ahe <br />allegations put forth by Stan Obenbaugh that prompted this <br />inspection were unfounded. <br />The only noted problem was a procedural issue regarding <br />import of off site material to the mine and for which you re- <br />quested that PS&G submit the necessary compliance document <br />covered by rule 3.1.5{9). <br />In a March 26,'2001 adequacy review response, Platte Sand & <br />Gravel LLC submitted the Inert Fi11 Notice and Affidavit. Due to <br />the shear volume of material we were supplying at that time to <br />address adequacy_issues it may have been overlooked. I found it <br />in my copy electronic of the file. You and I-.were able to <br />confirm it in the Division files on 3-March-2006. Therefore, <br />there was not problem since Rule 3.1.5(9) was addresses before <br />the permit was issued in August 2001. <br />In the Notice, PS&G committed to keeping a log of the <br />imported fill and making it available with the annual report. <br />Per our discussion regarding the source of the material imported <br />at this time I have included the current log. The 800 yds of <br />topsoil came from a residential lot over-grading project PS&G's <br />owners did on their property in Littleton, CO. It was clean <br />topsoil that will be used to resoil disturbed areas in the, mine. <br />Approximately 150 yards of concrete rubble has been:.delivered to <br />the mine .since September-2005. This rubble. is delivered_as haul <br />back from projects PS&G we sell material to. Most is from <br />concrete truck wash out areas and has no rebar. It will be used <br />to armor the lake banks as needed. It is being stockpiled for <br />curing and will be used as approved along the lake banks. IT is <br />not PS&G's intent to make this mine an inert material collection <br />site but there is a need for a large quantity of riprap material <br />
