III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. No one represented the operator. There was no activity on site due to Good Friday. <br />Facilities <br />Most of the coal stockpile has been removed. The berm on the outer edge of the facilities bench was <br />functional. The berm azound the fuel facilities was also functional. There were no fuel leaks. No <br />problems were observed at the material storage azea and at the truck maintenance facilities. <br />Roads <br />The paved section and the unpaved section of the haul road were in very good condition. The east <br />access road was in good shape as well. <br />Hydrology <br />There was very little water in Pond No. 1 while Pond No. 2 was dry. Pond embankments were stable <br />and spillways were functional. <br />The silt fence and straw bales were in place along the railroad tracks. Ditches were cleaz around the <br />mine site. <br />Siens and Mazkers <br />Mine ID signs were up at the appropriate locations. <br />Two soil Stockpiles <br />There was no gullying at the topsoil stockpiles. <br />c: \ms97\tertor\ i n sp 0400 <br />
