ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~~-~ es;~_nI 5 <br />INSPECTION DATE: B/91/n~ INSPECTOROS INITIALS: RK <br />OBSERVATION <br />The Division conducted a follow up monitoring inspection of the site on <br />8/31/06. As reported in previous inspection reports, the pit area had been <br />under water due to a breach along the North West side of the Arkansas <br />River, measuring approximately 300 feet. Operator with approval from the <br />Army Corps and DAMS had been granted to repair the bridge. Since the <br />approval and the repair work, the area received approximately 4 inches of <br />rainfall, which caused additional water to drain into the pit. Operator had <br />been diligently pumping the water from the pit, unfortunately the recent <br />event set the operators effort to drain the pit a bit longer than expected. <br />With representatives from Army Corps, and the operator, the breach area was <br />inspected. Approximately ~ of the breach has been repaired with Donnies and <br />poured concrete over the slabs for stabilization. Pit was still under <br />water, no pumping was taking place at the time of the inspection. Army <br />Corps granted the operator to remove the sand bar along the breach area of <br />the channel to facilitate the flow away from the pit. Such scooping of <br />material from CHANNELS does not require a permit from the Army Corps as <br />long as the operation only involves scooping of the material from the <br />channel and placing it along the channel embankment or a designated area. <br />Operator was informed that even though removal of the material is permitted <br />under the Army Corps, it does not mean similar operation can take place in <br />the pit area. The current permit for the site does not allow wet mining. If <br />the operator wants to change the mining plan for the pit from dry to wet, a <br />Revision to the permit has to be submitted and approval from DRM3, <br />obtained, prior to commencing with wet mining.
