ORIGINAL -PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn-~nnn_nat <br />INSPECTION DATE: ?(25/n7 INSPECTORDS INITIALS: ~~ <br />OBSERVATIONS <br />The Division conducted a monitoring inspection of the site as part of sites to be <br />inspected during the fiscal years 2007 & 2008. Present during the Inspection was Mr. Daryl <br />Fisher of Fremont paving and Redi Mix. <br />1) Site is 112 construction materials operation located approximately 5 miles East of <br />Pueblo, along the South side of Highway 50 covering 448 acres. Post Mining Land use <br />is water storage. According to the Stet Engineer, the operator has adequate water <br />rights to accomplish the task. <br />2) Site is a phased dewatering operation, with maximum affected acres of 50 at any <br />given time. It was active at the time of the inspection. <br />3) The Division received a fax from Miss Denise Gonzales of Fremont Paving & Redi Mix <br />on 7/23/07 requesting an increase of the affected acres to 80. <br />4) The entire affected acres were driven and inspected. All of the permit area is <br />fenced and appropriate permit sign was posted at the access to the permit area. <br />5) Large quantities of stockpiled processed material was noted along the west side of <br />the permit area. <br />6) Mining is continuing along the East side, with front end loader and dozers. The pit <br />was being dewatered at the time of the inspection. Operation has an active NPDES <br />Dewatering permit from CDOH&E. <br />7) Overburden/Topsoil stockpiles appeared to be properly protected. Operator was <br />notified to re-seed all salvageable top soil stockpiled if it is not going to be <br />used in reclamation with in 180 days. <br />8) Operator has a noxious weed control plan and no major noxious weed infestation was <br />noted at the time of the inspection. <br />9) When the site was succeeded by Fremont Paving and Redi mix on 10/13/2006, the <br />operator was only required to post a warranty that was already in place under the <br />option they chose which $50,000.0 was. The Division was supposed to calculate the <br />warranty with in 60 days. Unfortunately that was never accomplished. <br />10)The current warranty for the proposed affected acres of 80 acres was calculated and <br />is enclosed with the inspection report.
