(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1987-028 <br />INSPECTION DATE October 4. 2005 <br />INSPECTOR'S INITIALS CBM <br />It should be noted that, although certain boxes under "General Inspection Topics" on the first page of this report are <br />marked, this in noway implies that certain violations found at previous Mined Land Reclamation Board meetings <br />have been cured or that corrective actions related to the Board Orders issued on January 21, 2005 and modified by <br />Board Orders of July 13 and September 15, 2005 have been completed to the Division of Minerals and Geology's <br />satisfaction at this time. <br />This inspection was done at the request of the Mined Land Reclamation Board to determine compliance with <br />changed Board Order due dates determined in the Board Meeting of August 31, 2005. In general, the Board <br />delayed compliance with completing interim sediment control measures until September 30, 2005 since the <br />inspection of August 22, 2005 indicated that the operator had made substantial progress in this regard. This <br />inspection found that the plan had not been completed and had not progressed any further than what was in place <br />by the Board meeting of August 31, 2005. The lower road crossing, referenced in the inspection report of August <br />22, 2005 was not completed (or even started) and the upper road crossing (road coming from the temporary <br />stockpile area) also was not completed. The operatorwas working on these crossings and on completion of riprap <br />installation from the upper road crossing to Taylor Gulch below the county (lower) road crossing during the <br />inspection. This work was almost complete when the inspector left the site at approximately 3:30 pm. <br />Since the inspection of August 22, 2005, the operator has disturbed more ground outside the permit boundary to <br />the west. Measurements on site indicated that approximately .75 acres has been disturbed above and to the west <br />of the largest and lowest pit area by tree clearing, access road building and blasting activities. In addition, the waste <br />dump has been extended to the south and trees have been cleared below the access road and to the west of the <br />waste dump in apparent preparation for extending the dump to the west. .These activities could possibly be in <br />violation of the Mined Land Reclamation Board Order of January 21, 2005 that placed a Cease and Desist Order on <br />any further disturbance outside the present permit boundary. See page 3 of this inspection report. The operator <br />will be notified of this possible violation under separate cover. <br />W hile extending the dump to the south, boulders were rolled down the dump face and overrode the silt fence at the <br />bottom. At the same time, the berm at the top of the dump face was not maintained as required by the temporary <br />sediment control plan initiated at the operator's request to lessen sedimentation to Taylor Gulch. A recent rainstorm <br />has eroded fines in the waste rock dump down off the face and over the silt fence and at least 600 feet down a <br />drainage west of Taylor Gulch. This is also a possible violation of CRS 34-32.5-116(4) (i) and Q) for failure to <br />stabilize or protect affected land so as to effectively control erosion and failure to protect areas outside of the <br />affected land from damage occurring during the mining operation and reclamation. The operator will be notified of <br />this possible violation under separate cover. <br />Responses to this inspection report should be directed to Carl B.
