Tatman) stating, "... we wish to state our position that <br />milling ore imported from other mining sites constitutes custom milling, which is an <br />industrial use ... not permitted in the Forestry District." <br />15 July '94 BCLUD ltr to MLRD (W. York-Feirn) stating, "It is our position that milling ore <br />imported from other mining sines constitutes custom milling, which is an industrial use, <br />and is therefore not permitted in the Forestry Disnict.' The letter further requests the <br />Coumy to be provided copies of certain COM, lnc_ submittals to MLRD. <br />25 July '94 MLl?,D inspection report lisu eighteen (18) completed corrective actions concerning <br />problems identified in the 15 June '94 inspection report. Lt was agreed that Operator <br />would sample both the top and bottom of ma~nitor wells and submit results on a <br />quarterly basis for a year (ref. item 14). Fraser), in reply m Fraser's letter of 271u1y, giving 30 <br />days to remove camper, reiterating County position against imported ore anti <br />requiring its discoadnuance. Also states that milling is as allowable acc_~s ,^^~ use <br />to mining, but trot as allowable pnnciual use. <br />4 Aug. '94 Gold Hill Mill is operating at approximately IB tons per day or 37`~ of capacity. <br />BCLU D continues in its previously-stated position that milling of imported ore cooscirutes <br />as industrial use not permitted in the Forestry Zone. State of Colorado Division of <br />Minerals and Geology gives coaditiooal approval of importation of ore, provided that <br />mineralogic analysis and legal ownership of ore by COM, loc. requirements are met. '`- <br />Thisplaces the Division in the unforatnate position of being an accessory to willful <br />violation of Boulder Coumy zoning regoirtmmt:_ <br />14 Aug. '94 Tailings spill, including overtopping of lined impoundment. Tailings ran downhill <br />about 100' into edge of woods, Quantity unlQtown, but not large. <br />17 Aug. '94 ML(tD (W. York-Feirn) inspection report identifies tailings spillage from mill building <br />at two places and across a IS' span along the west of the tailings retention dam (PV, <br />correction deadline 8/24/94); tailings impoundment has very little freeboard sad may not <br />have ability to contain more tailings (PV, correction deadline 9/1/94). Impoundment <br />liner has several rips and holes (PB, cort~ection deadline 9/10/94). <br />17 Aug. '94 NOV to COM, Inc. for tailings syill. <br />22 Aug. '94 BCLUD (M. Sprague) hr to COM, loc. ((i.
