III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was an partial inspection conducted by Janet Binns. The mine is a reclaimed underground mine, with no <br />facilities and no personnel remaining on site. The mine site is snow covered. Site conditions were above freezing <br />though approx. 2-3 foot of snow remains in the yard area (snow level is up to 3id wire on fence). East facing slope, <br />portal area, has melted off considerably but still has snow cover over [he backfilled portals. <br />Records: Mine records were checked in the Routt County Courthouse. The Apex No. 2 2000-Midterm Findings <br />document was received at the court house 2/14/01. The Midterm documents were with the Apex No. 2 files. No <br />other Apex files were found in areas other than the Apex file area on the shelf containing the permit document. <br />Inspection reports from 8/99 to 2/00 were on file and were received by the Routt County clerk and recorder on <br />2/1/01. Fourth quarter 2000 pond inspection report is on file. The insurance document was received 2/1/01 and is <br />valid until 3/12/01. Please assure proof of valid insurance is updated with the Division and with the Clerk and <br />Recorder prior to the expiration date. DMR reports for 3r° and 4's quarters of 2000 were on file. NOC CV-2000- <br />001 abatement is fulfilled. This NOV is terminated with this inspection. <br />Roads: Routt County keeps Routt County Road No. 29 plowed. Drainage across the road remains good with no <br />puddling observed. <br />Hvdroloeic Balance: The pond is snow-covered.. No problems were noted with the permanent drainage at the <br />north end of the permit area. <br />Slides: Back filled portal slopes appear stable. No new rock fall was observed from the outcrop above the <br />backfilled slopes or from the pre-law road cut adjacent to Routt County Road No. 29. <br />Snow machine tracks were noted across the mine site. <br />Page _3_ of _4_ Pages, (date) _03/01/01 , (initials) <br />
