III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This permit is in temporary cessation. <br />The inspection started with a check of records at the offices of Hydro-Environmental Solutions, Inc. at <br />11:30 AM. The inspection of the loadout site began at 13:50 PM. <br />Availability of Records <br />See the DMG Availability of Records Check Sheet at the end of this report. All required records were on <br />file. <br />Signs and Mazkers <br />Mine identification signs and topsoil markers aze up and in good repair. <br />Roads <br />Roads are in a minor state of disrepair. No (approved) new work has been accomplished. <br />Backfill and Gradine <br />With the exception of backfilling and grading associated with the laying of underground water lines, no <br />part of the required (eventual) backfilling and grading of disturbed areas has been accomplished (there <br />has been no demolition of structures or reclamation). <br />Hydrologic Balance <br />There were no dischazges from Sedimentation Pond 1 or Sediment Pond 2. There was no surface <br />runoff. The site was dry. <br />Support Facilities <br />Structures, other than the sedimentation ponds and ditches, aze in disrepair. Some structures have been <br />vandalized. Temporary repairs have been made. The barrel of the primary spillway of Pond 1 appeazs <br />to be rusting out. No permitted construction on the conversion of the site to a coal load-in facility has <br />been initiated. <br />Topsoil <br />The topsoil storage piles were stable.
