III. COMMENTS -COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. Jeny Nettleton (Nettleton) of Twentymile Coal Company (Twentymile) accompanied Byron Walker (Walker) of the Colorado Division of Minerals and Geology (Division) during this inspection. After the joint inspection, and as discussed with Nettleton, samples were taken at various locations outside the permit azea from streams in the region and tested for conductivity, pH and temperature by Walker. Results are attached. No new items of concern were identified during this inspection. Items of concern from previous inspections include the following. See discussions regarding these items under inspection topic headings. • Identification signs displayed at each entrance to the permit area from public roads (completed). • Maintenance of topsoil storage markers (completed). • Repair of the outlet of one of the four 18-inch corrugated metal pipes (CMP) at the switchback up onto the working surface of the coal waste disposal site (completed). • Clearance of partial blockage of roadside ditch at the east entrance to the Tipple 2 loadout tunnel (completed). • Uniformity of markers that delineate the perimeters of azeas affected by surface operations or facilities markers [Rule 4.02.1(2)] (in work). • Revision of page 2.03-37 of the Permit Application Package (PAP) to reflect current practices by Routt County (County) with regard to the numbering of County Special Use Permits (in work). • Cleazly indicating boundaries of areas authorized for disturbance on maps of the PAP (in work). • Approved design of the sediment control measure for the temporary belt structure storage area (in work). • Approved design of the sediment control measure for the CYCC office area (in work). • Approved design of the sediment control measure for the "Trudy's" corner storage and training azea site (in work). • Protection of the topsoil storage pile at the North West Mains Ventilation Shaft (programmed). • Maintenance of the sediment control measure at the # 7 North Escape Shaft (in work). AVAILABILITY OF RECORDS Page 2.03-37 of the PAP needs to be revised to reflect current practices by the County with regard to the numbering of Routt County Special Use Permits. This item was first noted during the May 19, 2004 inspection [Rule 2.03.10(3)]. The scope of a minor revision to update this administrative description was discussed during this inspection.
