Cottony <br />Acting Division Director <br />RE :Status of Groundwater Investigation, Possible Impacts From Dry Mining & <br />De-watering Activities at The Platte Valley Pit, Permit No. M-89-I"LO <br />Class: Inspection; Type-Seq.: 5/30/02lnspection <br />Dear Mc Brancucci: <br />As you may know, the Division of Minerals & Geology (Division) and the Office of the State Engineer (OSE) <br />have been investigating written complaints of possible adverse impacts to groundwater users in the Brighton <br />area resulting from dry mining and de-watering activities at the Platte Valley Pit. The OSE has regulatory <br />authority for administration of water rights, determinations of material injury to surface water and groundwater <br />users, and determinations of whether Aggregate Industries is in compliance with Colorado statutes regarding <br />water supply, use, and management. Please see attached copy of July 8, 2002 correspondence from the OSE <br />regarding the status of their investigation. Also, I have forwarded a copy of the July 24, 2002 groundwater <br />modeling study prepazed by Martin and Wood Water Consultants, Inc. to Kevin Rein of the OSE for review. <br />For further information regarding these concerns, please contact Kevin Rein at (303) 866-3581. <br />The Division's role in this investigation has been to determine whether Aggregate Industries is in compliance <br />with the approved mining and reclamation plan and Colorado statutes regazding the extraction of construction <br />materials- W e-]lave-determined-that~.ggregate-Irldust~ies has-e~tcavated a larger ~cieage than-currently allowed <br />under the terms of their mining and reclamation permit. Our Division is taking appropriate actions [o ensure <br />that the site is adequately bonded and that this concern is resolved in a timely manner.
