-~ <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals and <br />Geology. No one else was present. Greg Lewicki, the operator's consultant was notified prior to the <br />inspection but was not present during the inspection. It was raining during the inspection. <br />AVAILABILITY OF RECORDS <br />Records kept at the Routt County Clerk and Recorder's office were checked for deficiencies noted <br />during the complete inspection done in July. The following nine documents still could not be found in <br />the records: <br />1. A legible insurance certificate, <br />2. Underground mining landowner notification, <br />3. 3 years of DMG/OSM inspection reports and enforcement actions, <br />4. Midterm Review documents, <br />5. NPDES Permit (most recent), <br />6. Stormwater Management Plan, <br />7. Map showing the entire permit boundary, <br />8. Map showing land ownership, <br />9. Map showing the extent of mining. <br />All nine documents should be inserted in the file. <br />SIGNS AND MARKERS <br />The two mine i.d. signs on County Rd. 29 still need to be updated to show the operator's current <br />address and phone number, and, as required by 4.30.1(3), the DMG's name, address, and phone <br />number. Other signs required on the site were up and contained the correct information. <br />HYDROLOGIC BALANCE <br />Sedimentation Pond <br />The pond is wet with rain water. <br />Ditches <br />Ditch D8 and the swale in the road appear to be functioning properly. <br />-3- <br />
