III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Marr Strip Mine and Walden loadout facility conducted on <br />July 19'~ and 20~', 2004 by Mike Boulay of the DMG. There were no representatives from Kerr <br />Coal Company present during the inspection. There was no activity at the mine site or at the <br />loadout facility. Weather conditions were cloudy, windy and warm. Ground conditions were <br />very dry throughout the mine site. <br />Availability of Records <br />Records were reviewed at the Montgomery Watson Harza office in Steamboat Springs on the <br />afternoon of July 20, 2004. During the last complete inspection it was noted that the latest <br />midterm review and associated reclamation cost estimate could not be located in the records file. <br />The DMG updated the records file with the most recent cost estimate and midterm review during <br />this inspection. Please see the attached Availability of Records checklist. <br />Roads <br />The permanent access road was dry. The surface of the road was rutted in several locations <br />probably due to traffic from the recent cattle grazing activity at the site. Road ditches were dry <br />and stable. Culverts were clear of sediment and debris and appeazed to be in good condition. <br />Hvdrologic Balance <br />All site sedimentation ponds were inspected. None of the site ponds were dischazging at the time <br />of the inspection. Ponds A, B, and D were retaining water, but at elevations well below the <br />primary spillways. -Pond C was dry. Pond E was retaining water at a level several feet below the <br />primary spillway. Ponds F and G were both dry. Pond embankments were stable at all sediment <br />pond locations and no problems were noted. <br />Revegetation <br />Vegetation is well established at the site but is beginning to tum brown due to the lack of <br />moisture at the site. It was appazent that the mine site has recently been grazed. This was <br />particulazly evident between Ponds A and B. During this inspection it was noted that at the head <br />of Ditch PD 1 vegetation is not as well established as other site locations. Netting is showing <br />through in the upper reaches of both ditches PD 1 and PD2; however, both ditches appeaz stable. <br />Two gullies were noted; one is located north of PD2 and drains southeast into PD2. The other is <br />located west of Pond F south of the county road. The gully drains into the perimeter ditch above <br />Pond F. Please monitor these gullies for signs of additional erosion. <br />
