III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken d~lring the inspection <br />and the facts or evidence supporting the enforcement action. <br />Coal Gulch, which currently bypasses the borrow area, will be diverted and permanently_ <br />routed through the bottom of the borrow area. The "hanging" section of existing channel <br />will be obliterated. <br />North Porta/Area <br />Final reclamation grading, topsoiling and seeding of the North Portal facilities area was <br />completed in the fall of 2002. Regraded contours appear to conform in general to approved <br />topography. No areas of significant settling, apparent instability, or excessive erosion (other <br />than Pond 13 inlet ditch noted above) are evident. Slope measurements documenting <br />apparent compliance were taken by the Division using abney level and stakes in September <br />2002 (Inspection Report Issued 9/16/021. <br />The need for construction of permanent ephemeral drainage channels across the reclaimed <br />area following removal of the upper diversion ditch and Pond 13 is also addressed in that <br />inspection report, and a plan for installation of the channels has been provided in TR-42, <br />currently under review. In addition, erosion of the Goal Creek channel adjacent to the North <br />Portal site is addressed in that report. The erosion initiated at a channel nick-point at a <br />former haulroad crossing location. Stabilization of the Coal Creek channel segment is also <br />being addressed within TR-42. <br />Certain facilities remain along the perimeter of the reclaimed area, including portions of two <br />topsoil stockpiles, a substation and power line that serve the loadout facility, and the <br />temporary sediment and drainage control diversions, berms, and sediment pond. <br />Exp/osives,Storage Bunker and access Road <br />This small disturbance area is located a short distance to the northwest of the North Portal <br />facility, and was reclaimed within the same time frame. The site has been properly graded <br />to blend into the adjacent terrain, and the surface was extensively roughened, seeded and <br />mulched. A section at the lower end of the small ephemeral drainage along the toe of the <br />reclaimed slope that had previously developed rills had been further stabilized since the <br />previous inspection. Riprap cobble had been placed over a fabric underliner. <br />Coal Creek Permanent Diversion Channel <br />The section of the Coal Creek Channel between the upper dip section crossing and the large <br />double culverts beneath Haul Road 4 is an approved permanent diversion. Approved interim <br />channel stabilization measures were implemented in 2001/2002 associated with CRDA-2 <br />reclamation. Several rock check structures were removed, and the channel was excavated <br />to deepen the channel along the upper portion and to provide a uniform grade through the <br />entire segment. Excavated material was used as cover material on CRDA-2. Riprap channel <br />bank protection was placed along the channel bank adjacent to Sediment Pond 6, <br />immediately downstream from the dip section culvert outlets. Permanent modifications <br />were made at the dip section structure, including installation of concrete wing-walls and <br />dismantling of metal railing. <br />
