0 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments indude discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of DMG. Henry Barbe represented the <br />operator. Several inches of snow covered most areas, limiting inspection access and ground visibility. <br />Snow was falling at the beginning of the inspection, but was melting later in the day. The long-wall <br />was active in B seam, panel 19 and development work was underway in E seam, panel 20. <br />During the inspection, I received a copy of the PR-1 O application (for delivery to the SEO) and an <br />original copy of the Q4-OS pond/refuse pile (which DMG recently requested). <br />Signs and Markers <br />Stream buffer signs were properly displayed in Sylvester Gulch. Amine i.d. sign and permit boundary <br />signs were properly displayed in the corrals staging/laydown area. <br />Roads <br />Roads in Sylvester Gulch and in the main surface facilities area were well-maintained. <br />Hydrologic Balance <br />Water was not discharging into Sylvester Gulch from the underground mine pumping site, CDPS <br />outfa11017. Pond MB-2R (CDPS outfall 004) also was not discharging. This pond's drop inlet <br />principal spillway (dmp inlet) and emergency spillway (rock riprapped channel) appeared to be in good <br />repair. The embankment and inslopes of MB-ZR appeared stable. <br />The wellheads of monitoring wells GP3, GP-4, and SOM-129H were in good shape, with wellhead <br />caps and i.d. mazkings in place. <br />To aid DMG's review of West Elk's 2004 AHR, the distribution of alluvial and colluvial deposits were <br />examined in the valleys of the North Fork and upper and lower Minnesota Creek. <br />Processing Waste <br />The face of the Refuse Pile Expansion pile showed no evidence of structural instability. Survey <br />mazkers were in place on the face of the pile. The top of the pile was has been graded smooth, and <br />gently slopes to the reaz of the pile. <br />
