<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Hamilton Coal Mine was conducted by Wally Erickson <br />from the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (970) 247-5469. No activities were observed, no mine personnel <br />encountered during the time of this inspection. Operator has commenced final <br />reclamation. <br />Signs & Markers -Mine identification sign was posted at the mine entrance. Permit <br />boundary markers were observed. Topsoil stockpiles were enclosed by fencing, topsoil <br />signs were posted. <br />Roads -Access to the mine site is provided by Montrose County Road HH31 from Hwy <br />141. Mine roads were dry and well maintained. Road side drainage ditches were <br />maintained and functional. Surface drainage from the mine entrance road is treated for <br />sediment by silt fence. Silt fence were loose from their posts. Road culverts were <br />clear and functional. <br />Hydrologic Balance -Sediment pond A, located at the far north end of the permit area, <br />was holding water, depth < 0.5', no discharge noted. Primary and secondary <br />spillways appeared clear and stable, no evidence of recent discharge. Pond <br />embankment appeared stable. <br />Sediment pond B, located at the NE corner of the permit area, was holding water, <br />depth approximately 0.5', no discharge noted. Elevation of impounded water was <br />approximately 1' below inlet elevation of primary spillway. Primary and secondary <br />spillways appeared clear and stable. Wetted area at outlet of primary spillway pipe <br />suggests that pond B may have recently discharged through its primary. Massive pond <br />embankment was well vegetated and stable. Evidence of erosion was observed at the <br />east side pond inlet. Lizard, turquoise blue color with yellow stripes across back, <br />yellow head and feet, and black bordered yellow shoulder collar, was observed within <br />the rock lining of the secondary spillway. <br />
