III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />since Pond C is being cleaned, the'mine water is being pumped into Pond B. The operator <br />stated that this mine water pumping is only once a week. The mine water appeazed to be <br />grayish to blackish in color due to the coal fines in the water. The water level in pond B <br />was at or just above the level of the primary spillway tube, so the pond had sufficient <br />capacity to handle a 10 year-24 hour precipitation event. The gated valve on Pond B was <br />closed so there was no dischazge. The cleaning out of Pond C will take a week. After that <br />time, the operator will pump the mine water into Pond C, rather than in Pond B. <br />In order to clean out Pond C, the operator had to build an access road through the top part <br />of the pond embattlartent. This shallow cut in the embankment will need to be filled in, <br />compacted and re-certified as soon as the Pond C cleaning is done. The water level in <br />Pond D was up to the primary dischazge tube. Pond D will be cleaned out when the work <br />on Pond C is complete. Ponds J and K were dry. The primazy and emergency spillways of <br />the sediment Bonds were functional. The embanlartents of Pond B and Pond C were <br />sparsely vegetated. Pond D is an excavated pond. The embanltments of Pond J and Pond <br />_K have no_v_egetation since the two ponds are new and have only recently_been seeded. <br />Culverts and ditches azound the mine site and unit train loadout azeas all had sufficient <br />capacity. However, there were several culverts that will need maintenance soon. The <br />outlet of the culvert under the entrance road to the upper pazking lot will need cleaning <br />soon. Also, the outlet of the culvert at the entrance to the mine site main topsoil stockpile <br />azea needs a little cleaning. Finally, the culvert at the entrance to the gob pile needs <br />cleaning at the inlet. <br />There was a very small seep to the west of the water tank bench azea. The seep flowed <br />only a few feet before percolating into the ground. The water had a slight tinge of orange <br />color. In the past, this seep water, when present, has been dazk orange in color. As has <br />been the case in the past, there was a small wet azea just to the west of the former slide <br />area above the portal bench.
