III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspecfion. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete oversight inspection. The complete inspection was conducted by Joe <br />Dudash of the Colorado DMG. Henry Austin of the Office of Surface Mining conducted <br />the oversight of the complete inspection. Bill Beaz represented Bowie Resources. <br />Roads <br />The paved haul road that nms from Old State Highway 133 up to the portal bench was in <br />excellent condition. The guardrail was in place and was functional. The haul road to the <br />gob pile and the road's outside protective berm were in very good condition. The access <br />road to the upper bench was passable and also had its outside berm. <br />5i¢ns and Mazkers <br />Mine ID signs were up at the appropriate locations and contained the correct information. <br />Surface disturbance mazkers were up around the mine site. <br />Topsoil Stockpile <br />There was a moderate to good vegetative cover on the mine site main topsoil stockpile. <br />The containment berm with the straw bales in the down gradient notch was functional. <br />The west side diversion ditch was also functional. No erosional gullies were evident. The <br />topsoil signs were present on the stockpile. <br />There were no problems noted at the topsoil stockpiles at the gob pile and the coverfill <br />stockpile. Straw bales and diversion ditches were functional. Topsoil stockpile signs were <br />up. At the unit train loadout topsoil stockpile, the diversion berm and collection ditch <br />were functional. However, the operator needs to put straw bales or silt fence at the <br />downgradient end of the collection ditch, to keep the topsoil from going down the ditch <br />and into the sediment pond. Although no such problems have occurred yet, this work <br />should be done very soon to avoid any future loss of stockpiled topsoil. Topsoil stockpile <br />signs were present. <br />Gob Pile <br />The operator was placing coaly pond cleanings from Pond C onto the gob pile. Since the <br />pond cleanings were very wet, the operator was mixing the cleanings with drier coal <br />
